From a third trial on the merits, Douglas Jackson appeals his multiple convictions for first-degree murder and kidnapping and the imposition of the death penalty for three first-degree murder convictions. We have jurisdiction. Art. V, ? 3(b)(1), Fla. Const. After appellants first trial, we reversed his convictions and death sentences based on the trial courts failure to grant a continuance due to defense counsels disabling physical condition. See Jackson v. State, 464 So.2d 1181 (Fla. 1985). A second trial ended in a mistrial. For the reasons expressed below, we now reverse the convictions and sentences, and remand this case to the trial court for proceedings consistent with this opinion.
